1. Who We Are

2. Eligibility

You must be at least 18 years of age to use FantasyCast. By using the Service, you represent and warrant that you are 18 or older. If we discover that a user is under 18, we will terminate their account immediately.

3. Your Account

You are responsible for:

• Providing accurate and current account information
• Keeping your password secure and confidential
• All activity that occurs under your account
• Notifying us immediately via the contact page if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for an extended period, or are associated with fraudulent activity.

4. The Service

FantasyCast allows you to:

• Connect your Sleeper or ESPN fantasy football league to the platform
• Generate AI-produced, multi-voice weekly fantasy football broadcasts using your league data
• Purchase credits and apply them to generate broadcasts for any week of the season
• Share your generated broadcasts via a public share link with your leaguemates

4a. AI-Generated Content

Your broadcasts are produced using third-party AI services for script generation and audio synthesis. By using the Service, you acknowledge that:

• AI-generated content may contain inaccuracies, errors, or unexpected outputs
• FantasyCast does not guarantee the accuracy, completeness, or quality of any AI-generated script or audio
• You are responsible for reviewing generated content before sharing or distributing it
• FantasyCast is not liable for any claims arising from AI-generated content you choose to share

4b. League Connections

By connecting a fantasy league, you represent that you have the right to access and share that league's data. You are responsible for ensuring your league credentials remain valid and up to date. FantasyCast is not responsible for failures caused by expired or revoked league credentials.

4c. Acceptable Use

You agree not to use the Service to:

• Upload or share content that is illegal, defamatory, harassing, or abusive
• Infringe on the intellectual property rights of others
• Attempt to reverse-engineer, scrape, or abuse the platform
• Circumvent usage limits, quotas, or access controls
• Use the Service for any commercial purpose other than your own personal league broadcasts
• Impersonate any person or entity

We reserve the right to remove content and suspend accounts that violate these terms without notice.

5. Your Content

5a. Ownership

You retain ownership of your generated broadcasts and any content you provide to the Service. We do not claim ownership of your league data, generated scripts, or audio files.

5b. License to Us

By using the Service, you grant FantasyCast a limited, non-exclusive, royalty-free license to store, process, and transmit your league data and generated content solely for the purpose of providing the Service to you. This license ends when you disconnect your league or close your account.

5c. License to Third-Party AI Services

To generate your broadcast, your league context and generated scripts are transmitted to third-party AI services for processing. By using the Service, you grant us permission to transmit this data to these services on your behalf.

5d. No Training Use

We do not use your content or league data to train AI models. We do not sell your content to third parties.

5e. Retention

• Generated broadcasts are retained until you delete them or close your account
• You may delete individual broadcasts at any time
• ESPN session credentials are retained only as long as needed to access your league and may be removed at any time

6. Payments

6a. Broadcast Credits

FantasyCast operates on a credit-based model with no subscriptions. You purchase broadcast credits as one-time payments and use them when you're ready. Credits never expire.

One credit = one weekly broadcast. All payments are processed by our payment provider. Prices are in USD. We reserve the right to change pricing; existing unused credits are unaffected by price changes.

6b. Free Credits

New accounts that joined the waitlist may receive free credits upon account creation. Free credits are non-transferable and subject to change.

6c. Refunds

All credit purchases are final. We do not offer refunds on broadcast credits. If something went wrong with your generation or you believe there has been an error, contact us and we will do our best to make it right.

7. Intellectual Property

The FantasyCast platform, including its design, code, branding, voice personalities, and all non-user content, is owned by North Cape Advisors LLC and protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the platform without our written permission.

The FantasyCast name, logo, and “Your league's weekly broadcast.” tagline are proprietary to North Cape Advisors LLC.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, FantasyCast disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted or error-free
• Generated content will be accurate, complete, or suitable for any purpose
• League data fetched from Sleeper or ESPN will be complete or current
• The Service will meet your specific requirements

9. Limitation of Liability

To the fullest extent permitted by law, North Cape Advisors LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of revenue, or reputational harm, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid us in the 3 months preceding the claim or (b) $50.

10. Indemnification

You agree to indemnify and hold harmless North Cape Advisors LLC, its members, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any third-party rights.

11. Third-Party Services

The Service integrates with third-party providers for authentication, data storage, payment processing, league data access (Sleeper and ESPN APIs), AI generation, and hosting. Your use of the Service is also subject to the applicable terms and policies of those providers. We are not responsible for the actions, content, or policies of third-party services.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination:

• Your access to the Service ends immediately
• Your generated broadcasts will be retained for 30 days before deletion, during which time you may request a copy
• Unused broadcast credits are non-refundable upon termination

You may terminate your account at any time by contacting us.

13. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Minnesota, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top and notify registered users by email if changes are material. Your continued use of the Service after any update constitutes your acceptance of the revised Terms.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and North Cape Advisors LLC regarding the Service and supersede any prior agreements.
